Deeds
Property is usually transferred to a new owner by either a Warranty Deed or a Quit Claim Deed.

  • Warranty Deed - the seller guarantees the buyer that (s)he owns total interest in the property. Any problems that may arise regarding title are the responsibility of the seller to resolve.
  • Quit Claim Deed - the seller guarantees the buyer that (s)he owns only the interest the seller had in the property. Any problems that may arise regarding title must be resolved by the buyer.

Certification of Title
It is advisable to have a lawyer conduct a title search to help ensure good title to the property.

The Certificate of Title confirms that a title search has been conducted on the property and in your lawyer's opinion it is a marketable title.

Right-of-way Agreements
If access to the property involves crossing lands owned by others, you should ensure there is a legal right-of-way. If a legal right-of-way does not exist, one should be acquired before purchasing the property.
